When a decision made by an official of state or local government is adverse to your interests, you may have the option to seek relief under Article 78 of the CPLR. Through an Article 78 proceeding, you can seek judicial review from a governmental agency's decision.

If you have been denied a zoning variance or special permit by the zoning board of appeals or have received an adverse determination by the planning board involving residential or commercial land use issues, you must take action promptly in order to preserve your rights. An Article 78 proceeding must generally be brought within a short period of time after the challenged decision is issued, sometimes as little as 30 days but no more than four months.
